Terms and Conditions
Important: By using our services, you agree to these terms and conditions. Please read them carefully before scheduling any service.
1. Service Agreement
Jackson ATV/UTV Services ("we," "us," "our") provides repair, maintenance, and related services for all-terrain vehicles (ATVs) and utility terrain vehicles (UTVs). By engaging our services, you ("customer," "you") agree to be bound by these terms and conditions.
2. Service Authorization
- All work must be authorized by the customer or their designated representative
- Written estimates will be provided for repairs exceeding $200
- Additional work discovered during service requires separate authorization
- We reserve the right to refuse service for safety or legal reasons
3. Liability Waiver
All customers must sign our ATV Shop Liability Waiver & Release Form before service begins. This waiver includes important limitations on liability and assumption of risk.
Required: Download and complete the Liability Waiver Form before your appointment.
4. Payment Terms
- Payment is due upon completion of service unless prior arrangements are made
- We accept cash, check, tap to pay, and Apple Pay
- A service charge may apply to returned checks
- Unpaid accounts may be subject to collection procedures and additional fees
- Vehicles may be held as security for unpaid service charges
5. Warranties
Our Work: We warranty our labor for 30 days from completion of service or 500 miles of operation, whichever comes first.
Parts: New parts carry manufacturer's warranty. Used or rebuilt parts carry a 30-day warranty.
Warranty Exclusions:
- Normal wear and tear items
- Damage due to misuse, abuse, or neglect
- Modifications not performed by us
- Environmental damage (water, mud, etc.)
- Racing or competition use
6. Customer Responsibilities
- Provide accurate information about the vehicle and its problems
- Remove personal belongings before service
- Pick up vehicles within 5 days of completion notification
- Maintain proper insurance coverage on the vehicle
- Follow all safety recommendations provided
7. Storage and Abandonment
- Storage fees of $10 per day apply after 5 days from completion notice
- Vehicles left longer than 30 days may be considered abandoned
- Abandoned vehicles may be sold to recover storage and service costs
- Customer is responsible for all storage fees regardless of pickup timing
8. Limitation of Liability
Our liability is limited to the cost of the specific service performed. We are not liable for:
- Consequential or incidental damages
- Loss of use, time, or profits
- Damage to items left in or on the vehicle
- Pre-existing conditions not directly related to our work
- Damage occurring after vehicle pickup
9. Safety and Compliance
- All work is performed in accordance with manufacturer specifications
- Safety inspections are recommended but not guaranteed unless specifically requested
- Customer is responsible for ensuring vehicle compliance with local laws
- We may refuse to perform work that compromises safety
10. Estimates and Pricing
- Estimates are provided in good faith but are not guaranteed
- Final pricing may vary based on actual conditions found
- Additional authorization required for work exceeding estimate by more than 10%
- Diagnostic fees apply and may be applied toward repair costs
11. Environmental Disposal
We dispose of oil, filters, batteries, and other materials in accordance with environmental regulations. Disposal fees may apply for certain materials.
12. Dispute Resolution
Any disputes will be resolved through:
- Direct discussion and negotiation first
- Mediation if necessary
- Arbitration in Perry County, Ohio if mediation fails
- Small claims court for amounts under jurisdictional limits
13. Business Hours and Contact
Our normal business hours are Monday through Friday, 8:00 AM to 7:00 PM. We are closed weekends. Emergency contact information is available for existing customers with urgent needs.
14. Privacy
Customer information is protected according to our Privacy Policy, available on our website. We do not share customer information except as necessary for service provision or as required by law.
15. Modifications to Terms
These terms may be updated periodically. Customers will be notified of significant changes. Continued use of our services constitutes acceptance of modified terms.
16. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
